Scope of application
The general conditions of sale detailed below (hereinafter, the "GCS") apply to all orders placed by non-professional buyers (hereinafter, the "Customer" or "Customers") with the company Poudre Organic for all items and services offered on the site POUDREORGANIC.FR. The GCS are systematically proposed at the time of placing an order and must necessarily be accepted for the sale to be concluded.
As a consequence, the fact of placing an order, implies the customer's full and unreserved acceptance of these conditions.
The customer declares that he/she has the capacity to contract: i.e. to be of legal age or an emancipated minor and not to be the subject of a protective measure.

Full conditions
A change in legislation, regulations or a court decision rendering one or more clauses of these general terms and conditions of sale null and void shall not affect the validity of the other clauses of the GTCS.
Such a change or finding shall not under any circumstances entitle the customer to withdraw from the GTCS.
The contractual relationship between Poudre Organic and its customers is governed by the GTCS accepted, as well as by the provisions of French law and current practice in the distance selling sector whose companies are based in France.
Subject
The purpose of the GCS is to define the rights and obligations of Poudre Organic and its customers in connection with the online sale of goods and services offered by Poudre Organic to the customer. The GCS thus govern all aspects of this activity, from ordering to delivery, including payment and use of services provided by POUDREORGANIC.FR.

2. Product availability
Poudre Organic undertakes to honour orders received only within the limits of available stocks of products or within the limits of stocks available from its suppliers. If a product is not available, Poudre Organic undertakes to inform the Customer as soon as possible.
Availability may vary from one day to the next depending on the level of sales. Poudre Organic very frequently updates availability, which is given as an indication only, on the POUDREORGANIC.FR, and cannot engage the responsibility of Poudre Organic. More precise information can be given to the Customer by telephone and e-mail.
Poudre Organic also reserves the right to modify the product assortment, in particular according to the constraints imposed by its suppliers.
3 : Prices
Prices are indicated in euros, inclusive of all taxes, and are only applicable on the date the order is validated by the Customer.
As the prices of POUDREORGANIC.FR suppliers are constantly changing, the prices displayed on the site may be modified at any time.
The prices shown for each item do not include delivery charges, gift-wrapping costs, any promotional offers or personal discounts. The "final" price to be paid by the customer may therefore be affected by these various elements, and is indicated before the final validation of the order by the customer.
Prices take into account the French VAT applicable on the day of the order, and any change in the legal VAT rate will automatically be reflected in the price of the products presented on the site, as soon as it comes into force. However, prices cannot be modified once the Customer has definitively validated his/her order.
Orders to countries outside the European Union are not subject to French VAT. The price to be taken into account by the Customer is therefore the amount exclusive of tax, which is indicated when the order is validated.
However, these orders are subject to any taxes and customs duties applicable in the country of destination. These costs and related formalities are the responsibility of the customer or recipient. They must be paid directly to the carrier at the time of delivery.
Order
1. Rejecting an order
Poudre Organic reserves the right to refuse any order from a customer with whom there is or appears to be a dispute during the processing of the order, and in particular a payment dispute.
2. Acceptance of conditions by the Customer
These GCS are accessible on the POUDREORGANIC.FR website and can also be sent by e-mail on simple request from the customer.
By ticking the box "I accept the general terms and conditions of sale", the customer declares that he/she has read and understood the GTCS and accepts them. 3. Ordering stage
The Customer can place an order with POUDREORGANIC.FR via the internet 24/7. The ordering process consists of 5 successive steps. Once the product selection has been made, the customer will be able to:
1. Go to the "View my basket" page, where they will be asked to validate the desired quantity for each product, enter any promotional code and then click on "Checkout"

2. Identify himself either by entering his email address and password, which are strictly personal to him, or by mentioning all the information usually requested for an online registration;

3. Clearly indicate the information required for delivery. This applies in particular to the precise delivery address as well as any accessibility restrictions of the delivery location (building, floor, digicode, etc.);

Once the payment method has been selected, the customer must proceed to the payment of his order on the secure interface, which will formalize in a firm and definitive way the sales contract that binds him to the company Poudre Organic.
The information delivered when placing the order is binding on the customer. In the event of an error in the delivery details, the company Poudre Organic cannot be held responsible for the impossibility of delivering the item(s).

4. Order confirmation
An e-mail is automatically sent to the customer to confirm that the order has been taken, provided that the e-mail address given in the registration form is correct. The e-mail confirming order processing and parcel dispatch will specify the parcel number and the link to the carrier's website for delivery tracking. The status of the order is also available in the "My account - My order history" section.
The customer is responsible for verifying the completeness and conformity of the information provided to Poudre Organic sarl by telephone or on the website. The latter cannot be held responsible for any input errors and the consequences in terms of delivery delays or errors. In this context, all costs incurred for reshipment will be borne by the Customer.
The company Poudre Organic reserves the right not to confirm an order for any reason whatsoever (problem concerning the order received or problem with the supply of items, ...).
As soon as this confirmation is sent, the sale is definitively formed and the full price of the products selected in the order is then immediately due.
5. Order tracking
The customer can check the status of his order at any time by consulting the "My account" section on the POUDREORGANIC.FR website. This tracking enables the customer to know the status of their order, as well as the status of shipment or delivery of their parcels. The latter is done by interfacing with the carriers' Internet tracking systems. Poudre Organic cannot therefore be held responsible for any unavailability or errors that may affect the information provided by its carriers. Nevertheless, Poudre Organic strives to make this information as clear as possible and to ensure the reliability of transport with its carriers. 6. Payment
It should be remembered that upon confirmation of the order by Poudre Organic, the full price of the items in the order is immediately due.
There are three possible means of payment to settle the order:
- Credit card (Carte Bleue, Visa, Mastercard): when the customer chooses this option, the site POUDREORGANIC.FR ensures total data security by means of encryption. In addition, the 3D Secure system can be used. Transmitted information is encrypted by software and cannot be read during transport over the network. Transmission is software-encrypted as soon as the padlock symbol appears in the browser. In addition, when the bank details (card number, validity date and cryptogram) are entered, the URL address becomes URL https (the "s" indicating security) and no longer an http address.

PayPal then acts as an intermediary between the buyer and Poudre Organic, and debit and credit transactions are almost instantaneous on PayPal accounts.
The customer can then verify that the transaction has been completed by logging into their PayPal account.
At no time does the customer communicate their banking information to Poudre Organic or any third party.
The company Poudre Organic sarl reserves the right to suspend any order management and any delivery in case of refusal of authorization of payment by credit card from the officially accredited bodies or in case of non-payment. In particular, Poudre Organic sarl reserves the right to refuse to make a delivery or to honour an order from a customer who has not paid in full or only partially for a previous order, or with whom a payment dispute is in progress.
.As part of an order verification procedure designed to ensure that no one is using another person's bank details without their knowledge, the customer may be asked to send a copy of an identity document and proof of address by fax or e-mail to Poudre Organic. The order will be validated only after receipt and verification by our services of the documents sent. In the absence of receipt of these documents within 15 days of the order being placed, the order will be deemed to be cancelled ipso jure.

7. Invoice
With a view to reducing the environmental impact of its activity, Poudre Organic has chosen to reduce the systematic use of paper printing as much as possible: in this context, the invoice is not attached to the dispatched package but available in the customer's "My account - My order history" section. Poudre Organic also keeps an electronic copy of each invoice. It should be noted that the order form that the customer establishes online or the order confirmation sent by email to the customer by Poudre Organic does not act as an invoice.

An e-mail is automatically sent to the customer when the products are dispatched, provided that the e-mail address given in the registration form does not contain any errors.
2. Shipping times
Transportation times depend on the carrier chosen by the customer and the delivery location.
Poudre Organic informs customers of the delivery times announced by the chosen carrier on an indicative basis. Shipping costs are calculated according to the country of delivery at the time of the shopping cart and are definitively confirmed according to the mode of transport and delivery destination chosen, before final validation of the order.

3. Means of delivery in mainland France
For home deliveries, if the recipient of the package is absent, a calling card will be left indicating where and when to collect the package. This will be kept pending at the Post Office for 15 calendar days. In the event of non-withdrawal within the time limit set by the carrier, the products will be returned to Poudre Organic, which reserves the right to reimburse the price of the products, with shipping costs to be paid by the Customer.

4. Packaging
Products are packaged to comply with current transport standards, and to ensure optimum protection of the products during delivery. The customer is asked to respect these same standards when returning a product, whether for after-sales service, or for a return for convenience. In the event of a product return, if it is found that the product returns damaged due to insufficient quality packaging, Poudre Organic may decide to refund only part of the product or refuse to refund it if it is impossible to resell in the same condition.

6. Carrier-related delivery delays
For any significant delay, the Poudre Organic company may compensate the customer with a commercial gesture that it deems appropriate.
In the event of a delay in delivery in relation to the times announced by the carriers, the customer should first contact the carrier or its distribution office in the case of La Poste, to see if the package is not pending. If necessary, the customer can contact customer service by telephone or e-mail POUDREORGANIC.FR in order to open a dispute or investigation file to carry out a parcel search.
Lost packages: The deadlines imposed by the carriers imply that the customer declares the loss within 10 days of receipt of the shipping notice from Poudre Organic. Under these conditions, Poudre Organic is responsible for making the necessary claims with the carrier concerned.
If the parcel is found, it will be re-routed immediately to the Customer's home address. In the event that the package is not found, the Customer may then request the return of the same product at Poudre Organic's expense, or a refund of the amount paid. If the product(s) ordered were no longer available at that time, the amount of the products concerned by the carrier's loss will be reimbursed.
Exceeded delivery times may not give rise to damages, withholding or cancellation of orders in progress, in the event of total or partial strikes, internal or external to the company, blockage of means of transport or supply, governmental or legal restrictions, etc.

7. Damaged packages
The customer must check the condition of the package in front of the carrier and make the necessary reservations on the delivery slip in the event of partial or total deterioration. In the absence of any reservations, the product is deemed to have been accepted by the customer and may not be the subject of any dispute concerning its delivery. The customer must inform the company Poudre Organic by e-mail as soon as possible, so that the latter can take the necessary measures as quickly as possible.
Right of withdrawal, return and exchange
The customer has a right of withdrawal of 14 working days from receipt of the order by the customer, to request a refund or exchange of a product, subject to availability. The returned item must be in new, unwashed condition, in its original packaging and with its label.
This right of withdrawal is conditional on the product being returned by the customer, within 14 days of expressing his/her wish to withdraw, in perfect condition and without having been worn or used.
The return is at the customer's expense, including any related customs fees.
The return is made at the customer's risk. It will be the customer's responsibility to keep any proof of shipment.
The Organic Powder company will not be liable for any loss or damage incurred as a result of the return.
Poudre Organic will refund the customer or send another item (in case of exchange) only after receipt of the returned product.
The return request can be made:
- Either by logging on to the POUDREORGANIC.FR, in the "Order History" section of My Account: simply tick the product and quantities to be returned, enter the reason for the return and validate by clicking on "Validate your return request". The customer's return request will then be studied and Poudre Organic will send a return authorization number to be affixed to the package, as well as the address where to ship the returned items.

Garanties
In accordance with the legal provisions applicable to the sale, the items sold benefit from the legal guarantee of conformity and the legal guarantee against hidden defects.
In the event of non-conformity of the products delivered or the existence of a latent defect, the customer has a period of 15 days to assert his rights, from delivery or the date of discovery of the defect.
Any warranty is excluded in the event of deterioration of the product attributable to the customer.
Finally, it is specified that in these hypotheses, the Poudre Organic company will cover the costs of returning the item, reimbursing the customer upon presentation by the latter of the carrier's invoice.
