The merchant site POUDREORGANIC.FR is operated by the company Poudre Organic SARL with a capital of 290.000,00 €, headquartered in AVALLON (38 rue Porte Auxerroise, please do not use this address for your returns) and registered in the Trade and Companies Register of Auxerre under the number: 801 842 899 (VAT identification number FR 04 801842899).

 

Scope of application

The general conditions of sale detailed below (hereinafter, the "GCS") apply to all orders placed by non-professional buyers (hereinafter, the "Customer" or "Customers") with the company Poudre Organic for all items and services offered on the site POUDREORGANIC.FR. The GCS are systematically proposed at the time of placing an order and must necessarily be accepted for the sale to be concluded.

Consequently, placing an order implies the customer's full and unreserved acceptance of these conditions.

The customer declares that he/she has the capacity to enter into a contract, i.e. that he/she is an adult or an emancipated minor, and that he/she is not subject to any protective measures.

Poudre Organic sarl reserves the right to modify these terms and conditions at any time. However, the version of the general conditions of sale applicable to an order placed by a customer on the POUDREORGANIC.FR website are those accepted by the customer at the time of placing the order, whether the order was placed by internet or by telephone.

Full conditions

A change in legislation, regulations or a court ruling rendering one or more clauses of these general terms and conditions of sale null and void shall not affect the validity of the other clauses of the GTCS.
Such a change or finding shall not, under any circumstances, entitle the customer to withdraw from the GTCS.
The contractual relationship between Poudre Organic and its customers is governed by the accepted terms and conditions of sale, as well as by the provisions of French law and current practice in the distance-selling sector whose companies are headquartered in France.

 

Object

The purpose of the GCS is to define the rights and obligations of Poudre Organic and its customers in connection with the online sale of goods and services offered by Poudre Organic to the customer. The GCS thus govern all aspects of this activity, from ordering to delivery, including payment and use of services provided by POUDREORGANIC.FR.

 

Product information

 

1. Product features

The information, characteristics, photographs and graphics presented on the sites or in the e-mails sent by POUDREORGANIC.FR are given for information only and are for the most part provided by the suppliers. In particular, Poudre Organic cannot be held responsible for any difference in the perception of shapes and colors between the photographs or graphics presented and the products themselves. Products are sometimes presented in photographs with other products. The description will mention what is or is not part of the product.

 

2. Product availability

Poudre Organic undertakes to honour orders received only within the limits of available stocks of products or within the limits of stocks available from its suppliers. If a product is not available, Poudre Organic will inform the customer as soon as possible.
Availability may vary on the same day, depending on the level of sales. Poudre Organic frequently updates the availability of products on the POUDREORGANIC.FR website, which is provided for information purposes only. Poudre Organic cannot be held responsible for any errors or omissions. More precise information can be provided by telephone or e-mail.

Poudre Organic also reserves the right to modify the product assortment according to the constraints imposed by its suppliers.

3: Pricing

Prices are indicated in euros, inclusive of all taxes, and are applicable only on the date on which the Customer sends confirmation of the order.

As the prices of POUDREORGANIC.FR suppliers are constantly changing, the prices displayed on the site may be modified at any time.

The prices indicated for each item do not include delivery charges, gift-wrapping costs, any promotional offers or personal discounts. The "final" price to be paid by the customer may therefore be affected by these various elements, and is indicated before the final validation of the order by the customer.
Prices take into account the French VAT applicable on the day of the order, and any change in the legal VAT rate will automatically be reflected in the price of the products presented on the site, as soon as it comes into force. However, prices cannot be modified once the Customer has definitively validated his/her order.

Orders to countries outside the European Union are not subject to French VAT. The price to be taken into account by the Customer is therefore the amount exclusive of tax, which is indicated when the order is validated.

However, these orders are subject to any taxes and customs duties applicable in the country of destination. These costs and related formalities are the responsibility of the customer or recipient. They must be paid directly to the carrier at the time of delivery.

 

Control

1. Refusal of an order

Poudre Organic reserves the right to refuse any order from a customer with whom there is, or appears to be during the processing of the order, a dispute, in particular a payment dispute.

 

2. Acceptance of conditions by the Customer

These terms and conditions are available on the POUDREORGANIC.FR website and can also be sent by e-mail on request.

By ticking the box "I accept the terms and conditions of sale", the customer declares that he/she has read and understood the terms and conditions of sale and accepts them. Consequently, by proceeding with the validation and confirmation of the order, followed by secure payment, the customer consents to the sale and to its being subject to the terms and conditions of sale.

The sale can only be called into question in the cases exhaustively provided for in the GCS under the paragraph "right of withdrawal".

Purchasing by telephone also implies acceptance of the General Terms and Conditions, which the Customer acknowledges having read, understood and accepted in the above-mentioned conditions.

3. Ordering stage

The Customer can place an order with POUDREORGANIC.FR by internet 24h/24h and 7d/7d. The ordering process consists of 5 successive steps. Once the product selection has been made, the customer can :

1. Go to the "View my basket" page, where you will be asked to validate the quantity required for each product, enter any promotional code and click on "Checkout".

2. Identify himself either by entering his email address and password, which are strictly personal, or by entering all the information usually required for online registration;

3. Clearly indicate the information required for delivery. This applies in particular to the precise delivery address as well as any restrictions on access to the delivery location (building, floor, access code, etc.);

4. Indicate the delivery method chosen;

5. Finally, please indicate your chosen method of payment.

Once the payment method has been selected, the customer must proceed with payment of the order on the secure interface, which will formalize the sales contract between the customer and Poudre Organic.

The information provided when the order is placed is binding on the customer. In the event of an error in the delivery details, Poudre Organic cannot be held responsible for the impossibility of delivering the item(s).

All orders. Any dispute on this point will be dealt with in the context of a possible exchange and the guarantees mentioned below (see Right of withdrawal).

In all cases, the online provision of the credit card number and the final validation of the order by the customer mark his acceptance of the price offer for the products selected and are proof of this acceptance.

However, the sale is only definitively formed after confirmation by Poudre Organic (see 4. Order Confirmation).

In addition, the archiving of purchase orders and invoices is made on a reliable and durable medium by the company Poudre Organic sarl and these documents will therefore be considered as proof of orders placed by the customer.


4. Order confirmation

An e-mail is automatically sent to the customer to confirm the order, provided that the e-mail address given in the registration form is correct. The e-mail confirming that the order has been processed and the parcel dispatched will specify the parcel number and the link to the carrier's website for delivery tracking. Order status is also available in the "My account - Order history" section.

The customer is responsible for verifying the completeness and accuracy of the information provided to Poudre Organic sarl by telephone or on the website. Poudre Organic sarl cannot be held responsible for any input errors and the consequences in terms of delays or delivery errors. In this context, all costs incurred for reshipment will be borne by the Customer.

The company Poudre Organic reserves the right not to confirm an order for any reason whatsoever (problem concerning the order received or supply of items, ...).

As soon as this confirmation is sent, the sale is definitively completed and the full price of the products selected in the order is immediately payable.

5. Order tracking

The customer can consult the status of his order at any time by consulting the "My account" section on the POUDREORGANIC.FR site. This follow-up enables the customer to know the status of his order, but also the status of shipment or delivery of his parcels. The latter is done by interfacing with the carriers' Internet tracking systems. Poudre Organic cannot therefore be held responsible for any unavailability or errors that may affect the information provided by its carriers. Nevertheless, Poudre Organic strives to make this information as clear as possible and to ensure the reliability of transport with its carriers. The customer may contact Poudre Organic's customer service department at any time to be informed of the status of his order. Customer service is available Monday to Friday.

 

6. Payment

It should be noted that upon confirmation of the order by Poudre Organic, the full price of the items in the order is immediately payable.

There are three ways to pay for your order:

-   (Carte Bleue, Visa, Mastercard): when the customer chooses this option, the POUDREORGANIC.FR site ensures total data security by means of encryption. In addition, the 3D Secure system can be used. Transmitted information is encrypted by software and cannot be read during transport over the network. Transmission is software-encrypted as soon as the padlock symbol appears in the browser. In addition, when entering bank details (card number, validity date and cryptogram), the URL address becomes URL https (the "s" indicating security) and no longer an http address.

Bank transfer (Poudre Organic's bank details will be indicated on the order form). All costs associated with this method of payment are at the customer's expense.

Paypal: the customer must first open a Paypal account. On the POUDREORGANIC.FR site, after validating the contents of the basket, the customer must choose the Paypal option for payment, then enter his or her email address, password, amount and currency. PayPal then acts as an intermediary between the buyer and Poudre Organic, and debit and credit transactions are almost instantaneous on PayPal accounts.

Customers can then check that the transaction has been completed by logging into their PayPal account.

At no time does the customer communicate his/her banking information to Poudre Organic or to a third party.

The company Poudre Organic sarl reserves the right to suspend any order and any delivery in case of refusal to authorize payment by credit card from the officially accredited bodies or in case of non-payment. The company Poudre Organic sarl reserves the right to refuse to make a delivery or to honor an order from a customer who has not paid in full or in part a previous order or with whom a payment dispute is pending.

As part of an order verification procedure designed to ensure that no one is using another person's bank details without their knowledge, the customer may be asked to send a copy of an identity document and proof of address by fax or e-mail to Poudre Organic. The order will be validated only after receipt and verification by our services of the documents sent. If these documents are not received within 15 days of the order being placed, the order will be automatically cancelled.

 

7. Invoice

In order to reduce the environmental impact of its activity, Poudre Organic has chosen to reduce the systematic use of paper printing as much as possible: in this context, the invoice is not attached to the dispatched parcel but is available in the customer's "My account - Order history" section. Poudre Organic also keeps an electronic copy of each invoice. It should be noted that the order form drawn up by the customer online or the order confirmation sent to the customer by e-mail by Poudre Organic does not constitute an invoice.

 

Transfer of ownership and risk

Poudre Organic retains ownership of the products delivered until full payment has been received from the customer. The above provisions do not preclude the transfer to the customer of the risk of loss or deterioration of the products subject to retention of title, as well as any damage they may cause, upon acceptance of the order by Poudre Organic.


Delivery

The customer can contact POUDREORGANIC.FR customer service for more information on delivery conditions in France or in a specific country in the world.

Orders to countries outside the European Union are not subject to French VAT. However, they may be subject to taxes and customs duties in the country of destination. These costs and related formalities are the responsibility of the customer or recipient. They must be paid directly to the carrier upon delivery.

The customer is also responsible for checking whether the products ordered can be imported under the laws of the country of delivery. We recommend contacting the customs authorities for further information.

1. Shipping times

Orders placed online via the POUDREORGANIC.FR website are collected every day from Monday to Friday, except public holidays. Upon receipt of the shipment confirmation e-mail, the Customer can take into account the delivery times of the carriers announced below.

An e-mail is automatically sent to the customer when the products are dispatched, provided that the e-mail address given on the registration form is correct.

 

2. Transport times

Transport times depend on the carrier chosen by the customer and the delivery location.

Poudre Organic informs customers of the delivery times announced by the chosen carrier. Shipping costs are calculated according to the country of delivery at the time of shopping and are definitively confirmed according to the mode of transport and delivery destination chosen, before the final validation of the order.

Delivery times do not include Saturdays, Sundays and public holidays.

 

3. Means of delivery in metropolitan France

For home deliveries, if the recipient of the parcel is absent, a delivery notice will be left indicating where and when to collect the parcel. The parcel will be held at the post office for 15 calendar days. If the products are not collected within the time limit set by the carrier, they will be returned to Poudre Organic, which reserves the right to refund the price of the products, with shipping costs to be paid by the customer.

 

Depending on the weight of the order, the different means of delivery in mainland France are :

  • Home delivery (usually within 48 hours)
  • Express home delivery by Chronopost 18h (usual delivery time 24 to 48h)
  • Delivery to relay points by Mondial Relay
  • Click & collect delivery to one of our boutiques

And in Europe and abroad:

The costs incurred depend on the country of destination and the total weight and volume of the items selected. Costs and delivery times are indicated to the customer before the order is confirmed.

Orders to countries outside the European Union are not subject to French VAT. However, they may be subject to taxes and customs duties in the country of destination. These costs and related formalities are the responsibility of the customer/consignee. They must be paid directly to the carrier upon delivery.

The customer is also responsible for checking whether the products ordered can be imported under the laws of the country of delivery. We recommend contacting the customs authorities for further information.

 

4. Packaging

The products are packaged in such a way as to comply with current transport standards, and to ensure optimum protection of the products during delivery. The customer is asked to respect these same standards when returning a product, whether for after-sales service, or for a return for convenience. In the event of a product return, if it is found that the product has been returned damaged due to inadequate packaging, Poudre Organic may decide to reimburse only part of the cost of the product, or refuse to reimburse the cost of the product if it cannot be resold in its original condition.

 

5. Gift wrapping

POUDREORGANIC.FR offers its customers a gift wrapping service. A fixed fee is charged for the gift-wrapping service, the amount is clearly indicated in the basket summary. Gift wrapping is not reimbursed in the event of a return or exchange.

 

6. Delivery delays due to the carrier

For any significant delay, Poudre Organic may compensate the customer with a commercial gesture that it deems appropriate.

In the case of a delay in delivery in relation to the times announced by the carriers, the customer must first contact the carrier or its distribution office in the case of La Poste, to see if the package is not pending. If this is the case, the customer may contact POUDREORGANIC.FR customer service by telephone or e-mail to open a dispute or investigation file to search for the parcel.

Lost parcel: The deadlines imposed by the carriers require the customer to declare the loss within 10 days of receipt of Poudre Organic's dispatch advice. Under these conditions, Poudre Organic will make the necessary claims with the carrier concerned.

If the parcel is found, it will be returned immediately to the Customer's home address. If the parcel is not found, the Customer may request the return of the same product at Poudre Organic's expense, or a refund of the amount paid. If the product(s) ordered were no longer available at that time, the amount of the products concerned by the carrier's loss will be reimbursed.

Exceeding delivery times may not give rise to damages, deductions or cancellation of orders in progress, in the event of total or partial strikes, whether internal or external to the company, blockage of means of transport or supply, governmental or legal restrictions, etc.

 

7. Damaged parcels

It is the customer's responsibility to check the condition of the parcel in the presence of the carrier, and to make any necessary reservations on the delivery note in the event of partial or total deterioration. If no reservations are made, the product is deemed to have been accepted by the customer and cannot be contested. The customer must inform Poudre Organic by e-mail as soon as possible, so that the latter can take the necessary measures as quickly as possible.

 

Right of withdrawal, return and exchange

The customer has a right of withdrawal of 14 working days from receipt of the order by the customer, to request a refund or exchange of a product, subject to availability. The returned item must be in new, unwashed condition, in its original packaging and with its label.

This right of withdrawal is conditional on the product being returned by the customer, within 14 days of expressing his/her wish to withdraw, in perfect condition and without having been worn or used.

Returns are at the customer's expense, including customs duties.

Returns are made at the customer's risk. It is the customer's responsibility to retain all proof of shipment.

Poudre Organic will refund the customer or send another item (in the case of an exchange) only after receipt of the returned product.

- Or by logging on to the POUDREORGANIC.FR website, in the "My order history" section of My Account: simply tick the product and quantities to be returned, enter the reason for the return and validate by clicking on "Validate your return request". The customer's return request will then be studied and Poudre Organic will send a return authorization number to be affixed to the parcel, as well as the address where to send the returned items.

- Or by contacting Poudre Organic's customer service department, using the contact form, by e-mail or by telephone, who will tell the Customer how to proceed.

Warranties

In accordance with the legal provisions applicable to sales, the items sold are covered by the legal guarantee of conformity and the legal guarantee of hidden defects.

In the event of non-conformity of the products delivered or the existence of a hidden defect, the customer has a period of 15 days to assert his rights, starting from delivery or the date of discovery of the defect.

Any warranty is excluded if the deterioration of the product is attributable to the customer.

Finally, it is specified that in these cases, Poudre Organic will cover the cost of returning the item, reimbursing the customer upon presentation of the carrier's invoice.

 

Personal data

Visitors to or customers of the POUDREORGANIC.FR site have the right to access, modify, rectify and delete data concerning them at any time, in accordance with article 34 of the French Data Protection Act of January 6, 1978.

When a customer registers or places an order, or in the context of other specific operations, Poudre Organic offers visitors or customers the opportunity to receive its newsletters, promotional offers, and/or to register to be informed of its exclusive sales. Visitors or customers may modify their subscription at any time via their personal account, or via the hypertext link at the bottom of newsletters received by e-mail.

Poudre Organic undertakes to effectively take into account modifications to subscriptions and unsubscriptions to commercial e-mails sent by Poudre Organic as soon as possible, depending on the processing required.

Poudre Organic may also offer its visitors or customers the opportunity to receive promotional offers from its partners. Poudre Organic may for commercial purposes transmit to commercial partners the identity and contact details of its Users or Customers, only insofar as they have agreed to the disclosure of their personal data. Users and customers may modify their choices at any time on the POUDREORGANIC.FR website.

Poudre Organic uses data collection systems such as cookies. A cookie is a computer file stored on the hard disk of the user's computer. Cookies make it possible to identify a previous visit to the site by the user, and to link the user to his or her personal data left on the site, in particular as part of the identification of the order basket.

Applicable law and disputes

Sales of products by Poudre Organic are subject to French law.

With the exception of disputes with a customer who is a merchant, which will be referred to the Commercial Court of Auxerre, any dispute arising from the interpretation or execution of these GTCS must be brought before the competent French court in accordance with the rules of common law.

Complaints or disputes will always be received with attentive benevolence.
